…aka “The Great Joke that is Indian Media – Part VIII” or…one standard for Sadhvi Pragya and another for Mohammed Shakeel & Zia-ur-Rehman.

On Oct 23, NDTV reported that

The Maharashtra ATS “…claim that they have evidence that Hindu groups were involved in the blast” in Malegaon

Note that although there was only one (single) blast, the headline of the story says: “Police claim to crack Malegaon blasts case” (notice the plural?)

The NDTV report also mentioned that

Evidence of a Hindu group’s involvement was found while tracing the origins of a scooter found in Malegaon.

The Times of India later quoted Jt Commissioner of Police (ATS) saying that

There is no specific organisation to which the three belong…

The ToI report also mentioned:

The Joint Commissioner denied they had found any links between the trio and other right wing groups like Sanatan Sanstha in Maharashtra whose members were accused of carrying out blasts in Navi Mumbai and Thane earlier this year.

To my untrained mind (and speaking as a layman), it reads like Sadhvi Pragya has so far only been accused not convicted

If you only rely on the English MSM (mainstream media) though, you may have missed that.  Also, I have not seen anyone rising to her defence yet…

Quite a contrast to the students of Jamia who are allegedly involved in the terrorist blasts (as in plural) in Delhi. In a statement issued Sept 22nd, their Vice-Chancellor Mushirul Hasan said:

…the university feels morally bound to defend its students until proven guilty and we will use the legal apparatus for this purpose.

Very good.

Sadly Sadhvi Pragya does not belong to any university and appears to be short on any kind of support.

Also Mushirul Hasan almost got away with accusing the police of lying about the involvement of Jamia students in the Delhi attack:

On Saturday, I informed the minister for human resource development, the secretary and joint secretary of the MHRD and the chairman of the University Grants Commission that Jamia students had no connection with the unfortunate incident.” However, he simultaneously confirms that two of the students picked up by the police on Sunday are on the rolls of the university. …but I have not seen any one accusing the Maharashtra ATS of that (yet).

I would like to end with a quote by Prof Hasan:

“ (the students)…cannot be branded as terrorists until proven guilty — and if they are proven guilty by the court of law, not a tear will be shed by anyone.”

P.S.Did anyone notice that the Sadhvi has been cleared of any involvement in the Modasa blast?

…Sabarkantha DSP KK Mysorewala also reached the city to question the Sadhvi in relation with Modasa blast. He gave her clean chit in the case.

“I interrogated the Sadhvi but didn’t find anything that could link her to Modasa blast,” he said.

    Investigators are finding Pragnya Singh Thakur alias Sadhvi Purnachetanand Giri, arrested by Maharashtra Police for her alleged involvement in the Malegaon blast case, a tough nut to crack. And they are blaming her expertise in meditation.

    Powered by her meditation training, the 36-year-old priestess knows how to control her mind and body mechanisms, said sources. It was only after this training that Swami Avadheshanand Giri anointed Pragnya as Sadhvi at the Allahabad Kumbh Mela last year.
    This has got the investigating agencies worried after subjecting her to polygraphic tests.
    A polygraph or a lie detector measures and records several physiological responses like blood pressure, pulse, respiration and skin conductivity when a person is subjected to a series of questions.

    It measures physiological changes caused by the sympathetic nervous system during questioning. These are different when people lie.

    But Pragnya, sources said, has been practicing the meditation methods since years and can control her responses making it really tough to believe if the answers even under the polygraph can be believed.

    2. Forensic tests on sadhvi Pragya draw a blank

    The two forensic tests-psychological profiling and polygraph tests-carried out on sadhvi Pragya Singh Thakur, key accused in the Malegaon blast
    case, on Saturday has failed to yield any fresh information.

    According to sources, she has not provided any additional information. The tests also indicated that she was not lying. The sadhvi was earlier subjected to brain mapping which also indicated that she was not holding back information.

    While on media, an apt post by Offstumped which makes two important points:

    It is now clear that the Communal Socialists in the media would not rest till the phrases “Hindu Terrorism”, “Hindutva Terrorism” and “Hindu Terrorists” gain enough currency to completely dilute India’s War on Terror and strategic response to Terrorism that swears by Islam and Jihad.

    It is disturbing to note that some who swear by Hindu Dharma are relishing the currency these phrases are gaining.

    It is disturbing not only because they maybe condoning terrorism but more importantly because of their lack of intellectual clarity that makes them succum to the media’s Orwellian tactics.

    Here is why the application of these phrases is patently wrong.

    Reason #1 – To date there is not even a shred of evidence to conclude that there is a conspiracy to commit acts of Terror by any organization let alone one that swears by Hindutva

    Reason #2 -Even if we were to indulge the theory floated in the media to date there is no factual basis to establish that those who have committed these acts of Terror have sought moral sanction from Hindu Dharma

    It is critical to make this important distinction

    – There is a variety of Terrorism that swears by tenets of Islam and goes to great length to quote from the Quran and Hadiths to seek moral sanction for its actions

    – It does not exclusively target one community and is generally secular in its choice of victims

    To date we have not been presented with any claims of responsibility by anyone by claiming moral sanction from any tenets of Dharma or any remotely hindu oriented doctrine of ancient or modern origin.

    If anything that can be told of these acts of terror in Malegaon and Modass it is that they were targetted at areas with a high probability that the victims would be Muslim.

    Offstumped Bottomline: Hence the correct phrase to describe these acts of Terror would be “Anti-Muslim” terrorist acts and those who have committed these to be “Anti-Muslim” terrorists. It is important to counter the media’s Orwellian bluster by exposing its intellectual skulduggery and by emphasizing intellectually sound phrases to characterize the nature of these acts.

    people like rajdeep sardesai/ barqa dutt/ prannoy roy and co ( english speaking yellow journals/ media and tv houses) know very well what they are doing.
    the smear campaign they have started isnt new, neither will it fade away.

    having a dedicated news channel will go a long way in our final goal of ridding bharat off its present crop politicians.
    can anyone advice me what it would cost in starting a news channel? and can a group of dedicated NRIs actually do this?
    since indian media these days beleives in cheap sensationalism, it would be wonderful to have a hard hitting news channel which combines truth with sensationalism.
    it would be like pay back time.
    but in the meantime its better we dont lose sleep over what ndtv and cnn ibn has to say becos watching such news channels only make your blood boil and is detrimental to our well being. i doubt even if prannoy roy watches it. ndtv and cnn/ibn is flatulence at its best.

    Now I know why Hindus were dominated. The clarity arose when I read from the report of the ATS that the Sadhvi has used ‘HER OWN BIKE’ registered in ‘HER NAME’for the malegaon blast.
    The other perople were brilliant they used unknown hired bikes.
    In spite of that our ATS took the same time to find the culprits!

    This case is a total fabrication, as till now they could not come out with a dust of evidence. Fabricated case on Sadhvi and others will not work. Truth having its own power to defeat untruth.

    Congress govt in Maharastra in 1993 Mumbai serial blasts said, one of the blasts was in mosque and muslim areas, so hindus should not feel it is Jihadi attacks on Hindus. Sarad pawar, who was CM, confessed this later on TV, as he did it to difuse Hindu anger and backlash. But it was a lie, blatent lie, to fool Hindus.

    Anti-Hindu Congress and its dirty designs must be exposed before whole nation. Hindus must wake up from silence, self-seeking approach, and secular traps.

    Cong man with saffron heart: NSUI leader punished for supporting sadhvi

    Surat, November 3: Rana had launched Vishwa Hindu Seva Samiti; his mother is the state INTUC vice-president

    Nirav Rana, who announced the new Hindu outfit, the Vishwa Hindu Seva Samiti (VHSS) in support of Sadhvi Pragya, here on Sunday, has turned out to be major embarrassment for the Congress.

    Nirav is the acting vice-president of the National Students’ Union of India (NSUI) — the students’ wing of the Congress in Surat. Besides, Urmilla Rana, his mother, an ex-Congress councillor, is the vice-president of the Gujarat unit of the Indian National Trade Union Congress.

    His mother also said his son was right in his actions. “My son took a decision and expressed his feelings. We are Hindus and so we should fight to protect ourselves. Sadhvi Pragya is innocent. Various tests like brain mapping and polygraphy among others were conducted on her but nothing came out of them. She should be released,” she said.

    This is by far the most serious bit of news in this development and…easily the most unsettling…

    The Mumbai Police on Wednesday arrested a serving Lieutenant Colonel for allegedly supplying money and explosives for the September 29 Malegaon blast. This is the first instance of an army officer being held in connection with with a terror attack.

    I have said this before on this blog…In a democracy, ONLY the State has legitimacy to use force.

    Anyone else who does that is effectively working against the national interest…and that cannot be excused. .

    P.S. Some hair-splitting going on here:

    New Delhi: The Army on Wednesday denied arrest of Lieutenant Colonel Srikant Purohit by Maharashtra Anti-Terrorism Squad (ATS) in connection with the September 29 Malegaon blasts.

    The army officer, who came under the scanner for his alleged role in the blasts, was stationed at the Army Education Corps Training College and Centre at Pachmarhi in Madhya Pradesh. He was doing a course in Arabic at the Army Education Corps College.

    “The officer is not under arrest. He has been accordingly detained by the ATS for the questioning. The Army Headquarters will take a further view on the matter based on progress of investigation by the ATS an availability of additional evidence, if any,” said Veerendra Singh, APRO Army.

    The main accused in the Malegaon blast case, Sadhvi Pragya Singh Thakur, is reported to have told her lawyer Ganesh Sovani that she has been framed. Her allegation may well be true in the light of unfolding events. For, the sudden emergence of ‘Hindu terrorists’ in the wake of the nationwide outcry over serial bombings, orchestrated by jihadi groups in major cities, is certainly suspicious. Sceptics see it as a ploy to divert attention from the UPA Government’s colossal failure to stem Islamic terrorism, as it bends over backwards to appease the Muslim community.

    Then, in last Gujarat elections, this TOI fabricated Modi said kill, kill him (about the terrorist killed by the police). And created hue-and-cry. When Modi sumbitted the tape to Election Commission, they found no such things. In the west, such media abuse would have costs TOI dear. BJP and Hindu leaders must learn to file lawsuits of crores of Rupees.

    I am sure if they go back a litle more they can link them to the assaination of Lincoln.

    A little more they can link up with Tutankahamen as he is was supposed to have been murdered.

    It appears that SIMI has said that they are involved init and also the Samjhauta Train blasts.
    The ATS is divided on this matter and it has supposed to have been reported also in a news paper.

    The report of the narco analysis test on SIMI commander Safdar Nagori and his close aides takes the wind out of the Mumbai Anti-Terrorism Squad (ATS) probe into the possible involvement of Hindu outfits and Army officers in the Samjhauta Express train blasts. Based on the ATS claims, a Haryana railway police team reached Mumbai on Thursday to interrogate Malegaon blast case suspects Lt Col Srikant Prasad Purohit and Sadhvi Pragya Singh Thakur.

    The findings of the narco test of Safdar Nagori and his associates, Kamruddin Nagori and Aamil Parvez, show no involvement of Purohit and Sadhvi’s in the Samjhauta Express blasts. On the contrary, they admitted the involvement of the SIMI and jihadi elements behind the train carnage and Malegaon blasts of 2006.

    The narco analysis test reports of the trio are with the ATS, Mumbai, which had also questioned the trio arrested by the Madhya Pradesh Police in March.

    A joint director-level official of the operations branch of the Intelligence Bureau, responsible for the parallel investigation into the Malegaon blasts, said the Mumbai ATS claims about the involvement of the Sadhvi and Purohit are “far-fetched” as SIMI’s involvement in the case is “beyond reasonable doubt”.

    Apart from the Samjhauta Express and Malegaon blasts, Nagori and his associates have also confessed to SIMI’s role and involvement of Muslims in terror attacks in Mumbai, Aurangabad, Hyderabad, Ajmer and the shootout at the American consulate in Kolkata.

    Nagori told the team of doctors of FSL, Bangalore, “In the Samjhauta Express blasts, some persons from Pakistan had come and they had purchased the suitcase cover at Kataria Market, Indore. One person from (SIMI) Tanzeem had helped them to get the suitcase cover stitched. SIMI leader Abdul Razak had helped the Pakistanis in the Samjhauta Express blasts.”

    Nagori also revealed that Razak had informed him beforehand about the Samjhauta Express blasts. Razak had sought the help of West Bengal SIMI president Misbah-ul-Islam for the Samjhauta explosions. Razak has a number of relatives in Pakistan, according to Nagori’s revelations. Kamruddin Nagori also concurred about Razak’s involvement in the Samjhauta Express blasts.

    Kamruddin said during drug interrogation, “There were good relations between Safdar Nagori and Abdul Razak. Abdul Razak had discussed the Samjhauta Express blasts with Safdar Nagori.”

    The banned outfit’s commander revealed that meetings were held by SIMI at Kurla, Kapadia Nagar and Mira Road in Mumbai for executing the terror attacks on Samjhauta Express and other blasts in the country. During the drug interrogation, Nagori revealed that SIMI has a strong presence in Maharashtra, including Malegaon, and he was “aware of the complicity of Muslims in the 2006 Malegaon blasts”.The 32-page narco analysis test report of Safdar Nagori, Kamruddin and Aamil Parzez quotes Nagori as having said, “In the Malegaon blasts (2006), some of the Muslim members were involved and that he (Nagori) was aware of it. SIMI members were involved in the Samjhauta Express train blasts.”

    Nagori said, “The Maharashtra SIMI members were to take houses on rent to take shelter and to complete the tasks and targets given to them… They were often changing their hideouts.” He admitted that some terrorists from Pakistan had also come to Mumbai and the entire SIMI network in Maharashtra was involved in the Samjhauta Express blasts.

    The report states, “He (Nagori) said Asif Khan from Maharashtra is his (Nagori’s) friend and that he is involved in the Mumbai train blasts and the blast at Aurangabad. After the blasts, Abdul Subhan alias Tauqeer and Asif Khan had gone to Hafeez’s house for hiding but did not find him at his place. Asif Khan met Tanvir and Yasir of Sholapur and they both arranged a hideout at Belgaum. Later, Asif was arrested from Belgaum.”

    The chargesheet in the Malegaon blasts (2006) case filed by the ATS, Mumbai, concedes the “extensive presence” of SIMI in Malegaon and the outfit’s anti-India designs for waging a war against the Government.

    Is the Anti-Terrorism Squad of Maharashtra Police a rogue organisation whose personnel see themselves as accountable to none and above the law of the land? Or is its brazen targeting of Hindu religious leaders and shocking attempt to tar the Army’s image part of a command performance? We must discount the first possibility because had the ATS been running amok, the State Government would have reined it in: The ATS is not free of Government control. Even if it were to be argued that the ATS has gone berserk and that there is no pattern to its deeds, the State Government would have to explain why it allowed matters to come to such a pass. What is more than likely is that the ATS, staffed by police officials who are more than eager to do the Government’s bidding for reasons that need not be elaborated, has been instructed to try and cause maximum damage to Hindu solidarity by defaming their religious leaders and holding them up to ridicule. The Congress obviously hopes this will weaken the BJP politically, cheer jihadis and swing the Muslim vote in its favour. In a sense, it is back to the days of dirty tricks when slander and defamation were used by the Congress to weaken its opponents. The services of agencies of the state, most notably the Intelligence Bureau, were commissioned for this purpose. What makes the latest spit-and-scoot venture of the Congress particularly insidious is the fact that it could result in a severe blowback with communal overtones.

    This is not to suggest that individuals involved in violent acts should go free. On the contrary, the law of the land should take its course and the guilty should be punished after a fair and transparent trial without short-circuiting the nation’s criminal justice system which operates on the basis of irrefutable evidence. But what we have seen ever since the ATS was let loose to malign Hindu society is an elaborate charade with ATS officials planting stories in gullible sections of media, peddling fiction as fact. It is by now clear that the ATS has miserably failed to gather even a scrap of evidence about the involvement of the accused in the September Malegaon blast that will survive judicial scrutiny in a court of law. What the ATS has succeeded in achieving is spinning cockamamie yarns that are at once absurd and ridiculous. If the media has been left looking silly for front-paging these yarns, the ATS has come across as a sinister organisation. Amazingly, while the ATS is yet to come up with conclusive evidence in the Malegaon case, it has darkly hinted the involvement of the accused in other incidents, for instance the bombing of Samjhauta Express. But it forgot to do its homework before levelling this outrageous allegation. The IB, as this paper has reported, already has conclusive evidence of the SIMI’s involvement in the bombing of Samjhauta Express. This only proves the point that the ATS has a political agenda and must be treated as no more than an extension of the ruling party’s dirty tricks department. Tragically, its follies will dim the image of similar units in other States and reinforce the popular view that our criminal justice system is in a shambles.

    The ATS claim that Purohit sourced RDX from the Army’s stock is debunked by the Army.

    The Indian Army is not known to use or store RDX, say sources. The explosives used by the Army are TNT and plastic explosives (PEK).

    Also, explosives seized by the Army in Jammu and Kashmir are either destroyed on the spot or handed over to the police.

    Besides, 60 kg of RDX is a huge quantity of explosives. If such a large quantity of explosives goes missing while in the Army’s holds, it would become a subject matter of a major inquiry.

    Lt Col Srikant Prasad Purohit was a Major when he was posted in Kashmir as a Military Intelligence officer and that is too low a position to manipulate such huge quantities of explosives.

    Also, seizures, in any case are effected by infantry and never by intelligence personnel. Purohit was never imparted, nor did he acquire any expertise in bomb making in the Army.

    There is now little doubt that the bizarre Malegaon Hindu Conspiracy Case is fast fizzling out, if ever it had any steam. This may be a relief for the individuals caught in the dragnet of “Hindu Terror,” but it is no consolation for the Institutions of State diminished in this contrived controversy – the Police, the Army, and the Judiciary.

    …The search for the nearest exit has probably begun, with palpable anger rising in the armed forces over the manner in which a serving officer was hauled over the coals for mere association with nationalist families whose existence causes current rulers to break into cold sweat. There is dismay that a fishing expedition was launched to catch any retired or serving officers who could be netted, without thought to the damage to the morale of the armed forces, and the confidence of the nation that holds them in such high repute.

    Mumbai’s Anti Terror Squad was doubtless politically pressurised to cook up the narrative of “Hindu Terror,” picking up pre-selected “culprits” to prove the script.

    …In the process, a section of the nation’s police force [which was cooperating across State boundaries to tackle the growing menace of jihad] was used to target the pre-eminent national institution – the Army. Not only has this shocked and demoralized the defence forces which are fighting multiple threats against the nation daily, it has put a spanner in the growing inter-State coordination between the police and intelligence agencies.

    …In this scheme, the institution whose prestige will suffer most in the long-term is the Judiciary – hitherto an institution on which the common man pinned his hopes in these troubled times. Mumbai judges have been giving a long rope to the ATS, and seeking no evidence in return for long incarcerations of accused. Thus, though no worthwhile evidence has been furnished against Sadhvi Pragya and others after so many weeks, the judicial remand of eight out of ten accused has been extended till 29 November.

    …As the story began to come unstuck even before it could be fully developed [some accused have yet to be arrested], the ATS was forced to deny that the 60 kg. of RDX allegedly stolen by Lt. Col. Purohit [denied by the Army] was used in the Samjhauta Express blast in February 2007. This was because the forensic report of the blast said that the material used was a highly flammable cocktail of fuel oils, potassium chlorate and sulphur. No RDX.

    …The decision to malign and arrest Hindu saints has so incensed the community that even Yoga guru Swami Ramdev has leaped into the fray. His invincible popularity combined with the eloquence of Sadhvi Ritambhara cannot but convince the Indian public that a “regime change at the Centre” is a national imperative.

    The Dharma of Counter Terrorism demands that the agencies of the State execute these operations in a manner that inspires confidence even in its most cynical critics.

    Unfortunately in the Malegaon Case while there is a legitimate reason to look for an anti-Muslim Terrorist group the conduct of the ATS through orchestrated leaks to the media and utter incompetence in informing the public of its actions have hurt its credibility and have diminished it as an Institution.

    What is the Dharma of society at large in the context of Counter Terrorism ?

    The Dharma of Counter Terrorism also demands that society at large be consistent in the freedoms it wants to forego to aid the State in conducting Counter Terrorism.

    There is no Dharma in doubting the credibility of the State’s actions just because the accused was of a saintly persuasion.

    There is no Dharma in questioning the legitimacy of the State’s actions just because the person tortured was a woman of saintly persuasion.

    There is definitely no Dharma in pronouncing the accused innocent even before the Judicial Process has carried out its Dharma to convict or acquit the accused.

    There is however Dharma in making a clear distinction between the Judicial Process inside the Court and the Politics of the Case outside the court.

    There is Dharma in calling out the conduct of the ATS in leaking information to the media

    There is also Dharma in calling out the political rumor mongering by the media that has tarnished reputations by claims based on unattributed remarks by unnamed sources.

    It is this distinction that is clearly missing first in the Panipat Conclave’s response to Malegaon over the weekend and in Mr. Advani’s statement yesterday.

    So what must the State do in Malegaon and what must the BJP and the media do ?

    The State’s Dharma in Malegaon lies in taking immideate measures to make the Peerbhoy case as the Gold Standard and hold its Malegaon investigations to the same degree of professionalism.

    The State’s Dharma in future Malegaon like cases would be to use all instruments available to it build a water tight body of evidence before going public with arrests. Some may ask doesnt Dharma demand that the State pre-empt terror. The answer is absolutely yes, the State must act to pre-empt imminent threats of Terror but in the absence of imminent threats the State must rely on other instruments of surveillance to gather a strong enough body of evidence rather than resort to illegal detentions and coerced confessions.

    Hence the need for a strong Counter Terrorism Legislative Framework and Federal Agency that allows the State to monitor, pre-empt and arrest so Terror can be defeated like the in the Peerbhoy case rather than detain, coerce and arrest like in the Malegaon Case.

    I, Sadhwi Pragyan Chandrapal Singh Thakur, Age 38 years, Occupation — Nil, residing at 7, Ganga Sagar Apartment, Katodara Road, Surat, Gujarat State do hereby state on solemn affirmation as under:

    1. I say that I am a resident of Madhya Pradesh. My parents live in Surat, Gujarat where they shifted residence a couple of years ago. I say that for some years now, I found myself becoming increasingly detached from the material world and correspondingly found tremendous comfort and solace in Spiritualism. Accordingly I decided to renounce the material world and become a Sanyasin. On 30.1.2007, after performing the appropriate Hindu Religious rites and prayers I became a Sadhwi. I say that ever since then, I have been residing in a ashram at Jabalpur, Madhya Pradesh. My life at the Ashram almost exclusively consisted of prayers, meditation, yoga and the reading of spiritual texts. At the ashram I did not watch TV channels and had practically no access to newspapers.

    2. I say that apart from my activities at the ashram, I travelled chiefly around North India for the purpose of religious discourses and sermons. In connection with these latter activities, between 23.9.2008 and 4.10.2008, I was in Indore where I stayed at the residence of one Annaji who is my disciple. In the evening of 4th October, 2008, I returned to my ashram in Jabalpur.

    3. I say that on 7.10.2008, when I was at Jabalpur Ashram, I received a call from a police officer from the ATS, Maharashtra, called Mr Sawant, who wanted to know about my LML Freedom vehicle. However, I told him I had sold it long back and not concerned with it. However, he insisted me to come down to Surat as he wanted to question me at length about it. I was reluctant to go to Surat by leaving the Ashram and insisted for him to come down to Jabalpur, but he refused and told me to come down to Surat as early as possible.

    4. I further say that accordingly I travelled to Surat by train via Ujjain and arrived at Surat on 10.10.2008 early in the morning and my disciple Shri Bhimbhai Pasricha had to receive me at Railway Station and I went to his place at Atop Nagar.

    5. I say that here at about 10 AM, I met officer Mr Sawant who had apparently travelled to Surat to trace the ownership of a LML Freedom two wheeler and I questioned him as to what had happened to my vehicle and why you are asking about it. I say that I it was at this point time, Mr Sawant told me that my vehicle had been allegedly planted with the explosives and subsequently detonated in Malegaon in the last week of September. I also say that it was here for the first time, I came to know that my old vehicle had been allegedly used in Malegaon blast, which was completely shocking to me. I confirmed to Mr Sawant that the LML Freedom 2 wheeler of the colour and number, he mentioned had once belonged to me.

    6. I say that in Surat during the course of my interrogation with Mr Sawant, I mentioned to him that the LML Freedom two wheeler once owned by me was subsequently sold to one Sunil Joshi of Madhya Pradesh way back in October, 2004 and that Mr Joshi had paid me Rs 24,000/- for the same. I had also signed the necessary TT Form for RTO transfer in October, 2004 itself. I categorically asserted to Mr Sawant that since October, 2004 I had no control over the vehicle or its movements and usage.

    7. I further say that in spite of my answers, Mr. Sawant repeatedly asked me how the vehicle reached Malegaon and how it came to be involved in the bomb blast on 29.9.2008. I repeatedly replied that I could not answer his questions as I had no control of the vehicle since October, 2004.

    8. I also say that Mr Sawant however informed me that he did not believe me and that I would have to accompany him and his ATS team to Mumbai for further interrogation and he assured me that after such interrogation I would be free to go back to my ashram.

    9. It is significant to mention that I was not formally arrested on 10.10.2008. Even though no formal summons to attend as a Witness was served upon me to make my self available for interrogation in Mumbai, and even though I was within my rights to insist that I be interrogated at the place where I reside ie Jabalpur, trusting Mr Sawant and having nothing to hide, I agreed to accompany the ATS team to Mumbai. I say Mr Sawant told me take my father along with me. However, due to his old age, I told him it was not proper take down him to Mumbai and suggested that my disciple, one Mr Bhimbhai Pasricha, in whose very residence my questioning was being done by the ATS. I further say that at 5.15 PM myself, Mr Pasricha and the ATS officer left Surat and reached Bombay on the very night of 10.10.2008. In Bombay I was taken straight away to the ATS office at Kalachowkie.

    10. Thereafter for two days I was detained and interrogated by the ATS team in Mumbai. The questions were repetitive and directed at somehow involving me in the bomb blast in Malegaon on 29.9.2008. My answers remained constant throughout.

    11. I further say that on 12.10.2008 the ATS changed the mode of interrogation and became extremely aggressive with me. At first they asked my said disciple Mr Bhimbhai Pasricha to beat me with sticks, belts etc, on my palms, forehands, soles, etc. When Mr Pasricha refused to do so, he was severely beaten by the ATS. Ultimately with the greatest reluctance, he complied with the ATS orders but obviously being my disciple, he exerted the very minimum of force on me. He was then pushed aside by a member of the ATS squad knows as Khanwilkar, who then himself commenced beating me severely with a belt on my hands, forearms, palms, feet, soles, causing me bruises, swelling and contusions in these areas.

    12. I say that from the 13th onwards, I say that I was beaten during the day, night and midnight. On two occasions I was even woken up in the early hours of the morning at 4 am and questioned about my knowledge of the blasts. On these occasions, I was beaten by a senior officer having a moustache, whom I can identify. In addition I was subject to vulgar abuse and obscene language by members of the ATS team interrogating me. My Guru was abused and my chastity was questioned. I was physically and verbally traumatised to the extent that I wanted to commit suicide.

    13. I further say that on 14th taken out for the examination at a far away place from ATS and was brought back in the afternoon and that I day I had no meeting or even knowledge about Mr Pasricha.

    14. I say that on 15th October, after noon, both myself and Mr Pasricha were taken by ATS vehicles to Hotel Rajdoot in Nagpada locality of Mumbai and were kept in Room Nos. 315 and 314 respectively and we were made to sign the Hotel Entry register, however, we did not pay or deposit any money with the hotel manager, which was done by the ATS.

    15. I say that after putting into this hotel I was asked to make phone calls from mobile No. 94066 00004 and from one more mobile instrument not belonging to me to speak couple of persons including one of my female disciple and I was asked to say that I was in a hotel in Mumbai and hale & hearty and was doing fine. I say that at that time, I did not know why I was made to say so. I would reveal the name of my female disciple at an appropriate time.

    16. I say that as a result of the custodial violence/torture, mental stress, anxiety that were developed in the process, I was subjected to, I developed acute abdominal and kidney pains. I lost my appetite, became nauseous and giddy and prone to having bouts of unconsciousness. In view of this, within few hours after putting in Rajdoot Hospital, I was removed from the ATS office and was taken a hospital which learnt it to be Shusrusha Hospital wherein I was kept in ICU. I say that within half an hour Mr Bhimbhai Pasricha came down to Shushrusha Hospital with some ATS men and my Hospital admission forms, and other medical examination forms, etc were signed by him. I say that Mr Khanwilkar deposited money to the hospital management for me, which I learnt from Mr Bhimbhai. I say that after some time Mr Pasricha left the Hospital along with the ATS men and thereafter I have no contact with of any nature.

    17. I say that I underwent a treatment over here for 3 to 4 days. I say that as my condition did not improve, I was taken to another hospital whose name I cannot recall. This hospital consisted of a high rise building where I was treated for 2 to 3 days. I say that no female police constable was by my side either in Hotel Rajdoot or in either of the two hospitals.

    18. I say that both at the hotel and the hospitals, I was carried on a stretcher and my face was always covered with a black hood to avoid my face from being seen. From the second hospital, I was brought back to the ATS office at Kalachowkie.

    19. I say that I was finally arrested on 23.10.2008 and produced before the Chief Judicial Magistrate, Nasik on 24.1.2008. I was remanded to police custody on that date till 3.11.2008. Up to the 24.10.2008 and even sometime thereafter, I was denied access to a Lawyer or any member of my family. A polygraph test was conducted on me while I was in illegal detention prior to 23.10.2008. Thereafter a second polygraph test was conducted on 01.11.2008. On 04.11.2008, after I was remanded to Judicial custody on being presented before Nasik court on 03.11.2008, I also say that a Narco analysis test was also conducted on me.

    20. I say that both the lie detector test as well as the Narco analysis test were conducted with out my consent. Never the less all these investigative tests have only established my innocence in the Malegaon bomb blast that took place on 29.9.2008. I finally was allowed to meet my sister Mrs Parthibha Bhagwan Jha on the evening of 02.11.2008, who had brought vakalatnamas of Advocate Ganesh Sovani who was engaged by my sister and her husband Mr Bhagwan Jha and had met him couple times in that week. This meeting was not conducted in private since members of the ATS stood within hearing distance of my sister and myself. I met my Advocate Ganesh Sovani for the first time in the court room of this Hon’ble Court very briefly for 4 to 5 minutes prior to the arguments commencing on my remand application on 03.11.2008.

    21. I say that this period of 4 to 5 minutes was too short for me to give complete instructions as to what had transpired from 10th October onwards, about my vehicle, my stay at Kalachowkie, my illegal detention, the ill-treatment mitigated to me by ATS men, the beating job that was forced on my disciple to beat me, but which he carried out reluctantly, without any force, etc. I say that for this reasons, all the details had not reflected in the hand written application that was placed on record by my advocate Mr Sovani, for paucity of time to give all these instructions.

    22. I say that on the evening of Wednesday 12.11.2008, I was allowed to meet my Advocate Ganesh Sovani for about 5-6 minutes again in the presence of female staff of Byculla jail. I say that again on 13.11.2008 I was allowed to talk to my said lawyer for 8-10 minutes to give him some more details. Thereafter, on Friday 14.11.2008 evening at about 04.30 PM, I was given nearly 20 minutes to talk to my said lawyer at length, and it was during this period I could narrate my entire ordeal with the ATS which is reproduced hereinabove.

    23. I unambiguously state that I am totally innocent of any offence whatsoever. In particular I have no connection with the Malegaon bomb blast of 29.9.2008. While my former ownership of LML Freedom 2 wheeler, which was allegedly used in the Malegaon bomb blast entitled the ATS to interrogate me, that agency was not entitled to subject me to the treatment mentioned hereinabove. Their conduct discloses a blatant violation of statutory provisions of law, custodial abuse and violence, mental and physical torture and prolonged illegal detention. The ATS are fully aware that I am innocent. It appears however that they have a mandate from their political superiors to necessarily implicate me with Malegaon blasts with a view to suggest that Hindu Religious extremists were resorting to terrorism. The prolonged illegal detention, custodial abuse and physical torture were designed to compel me to confess to crimes I had not committed. This attempt of false implication persisted for the entire period between 10.10.2008 and 02.11.2008 . During this entire period I was deliberately isolated from my family and denied access to Lawyers. I say that no arrest panchanama was done after my arrest on 23.10.2008 and I was never asked about the names, addresses and telephone / mobile Nos. details to whom I would like to convey my arrest. I say that attention from my illegal detention was sought to be diverted by the ATS by daily leaking information regarding my involvement which was manifestly false and only indicated the malafide nature of the investigation..

    24. I say that While I was thus painted as a sinister mastermind of the Malegaon blasts, a role which has now been subtly reassigned by the ATS to Lt Col Purohit — crippled and vulnerable as I was by the detention, abuse and torture, I could not protest my innocence. Nor was I allowed access to family, friends and Lawyers who could have done so.

    25. I say that it is necessary that a detailed enquiry of my illegal detention, custodial torture, etc needs to be done and for which I am ready and willing to get subjected to any such medical test or tests and I also want the ATS officers, who interrogated me, tortured me, etc should also be put to the same tests.

    26. I say that the ATS has caused blatant violations of my human rights and I should get a justice and they need to be adequately dealt with as per the provisions of law.

    27. In the circumstances I now pray for the following relief:

    a) that the ATS be directed to submit an explanation for my detention without authority of law between 10.10.2008 and 23.10.2008;

    e) that a report be called for from the ATS for the reasons of my admission in two hospitals ( Shusrusha an another) and the medical treatment undergone by me at the said two hospitals;

    f) The ATS be directed to disclose the reasons for my stay at Hotel Rajdoot at Mumbai.;

    g) For such further and other reliefs as may be fit and proper in the facts and circumstances of the case.

    There is now further evidence, if at all it is needed, to suggest that the so-called investigation by the Maharashtra Anti-Terrorism Squad into the Malegaon explosion on September 29 is fast turning out to be a sinister conspiracy. The conspirators appear to be driven by no other motive than to destroy the lives and reputations of individuals, among them a decorated officer of the Indian Army, in the hope of fetching electoral gains for the Congress which is desperate to appease jihadis and their patrons in the wake of the Batla House encounter in which two Muslims, believed to be involved with terror bombings planned and executed by the Indian Mujahideen, were killed. The busting of terror modules and the pace set by the Gujarat Police have also unnerved the Congress and its allies who now feel obliged to be seen as ‘punishing’ Hindus to reaffirm their ‘secular’ credential. Nothing else explains why the ATS should have invoked the stringent Maharashtra Control of Organised Crime Act on Thursday against the 10 people arrested for their alleged involvement in the Malegaon incident. Ever since the Maharashtra ATS began its witch-hunt, it has not been able to produce even a scrap of sustainable evidence; all that it has done — arguably with remarkable success thanks to those sections of the media which are only too happy to peddle fiction as fact — is to plant fanciful stories through anonymous sources, many of which have been subsequently denied. For instance, the Maharashtra ATS has had to withdraw its stunning claim that the accused were involved in the bombings on Samjhauta Express when confronted with evidence to the contrary. This has, however, not dampened the enthusiasm of the calumniators to defame the accused and deny them their rights under the law of the land. Obviously the Maharashtra ATS could not have functioned in such an outrageous manner had it not been instructed to do so by those in power in New Delhi and Mumbai. The Maharashtra ATS chief is welcome to insist that there is “zero political pressure” on him and his men, but such assertion will impress only the naïve and those who are comfortable with the cynical politics of the Congress which can go to any extent to push its vicious agenda.

    It would be in order to record that the Maharashtra ATS has invoked Section 3 of MCOCA against the accused, including Sadhvi Pragya Singh Thakur and Lt Col SP Purohit, which provides for the death penalty if a crime has led to the death of an individual. By invoking MCOCA, the Maharashtra ATS has also ensured that it can detain the accused for a longer period of time without framing charges against them or being made answerable in a court of law. If in the end the case collapses, those guilty of such blatant abuse cannot be held accountable — they know it, so do their political patrons. This newspaper reiterates that if a crime has indeed been committed, the guilty should be punished through due process of law, irrespective of their status or religious identity. But short-circuiting the process is not the answer; it only raises serious and disturbing questions and indicates unwholesome motives. Meanwhile, we should ponder over the fact that the alacrity with which a tough law that provides for the death penalty has been invoked against ‘Hindu terrorists’ is in sharp contrast to the Congress failing to carry out the death sentence against a convicted jihadi terrorist: Mohammed Afzal Guru will bear out this point.

    RSS calls ATS report a ploy to divide

    The Rashtriya Swayam Sevak Sangh (RSS) on Friday (November 21) reacted to the leaked Mumbai Anti-Terrorism Squad (ATS) report saying that it is a deliberate attempt to divide the Hindu community. Calling for an investigation into the leak that has happened from the ATS, the RSS has criticised the leaking of the information callously of Jihadis targeting senior RSS leaders.

    RSS leader Ram Madhav lashed out at the ATS saying it is a ploy to discourage people who are standing firmly behind the Malegaon blast accused. “It is an effort to de-motivate the support base of the Malegaon accused. The ATS does not have any evidence till now to prove their involvement. However, I reiterate that investigation into the case should continue and let truth prevail,” he said.

    Some of these factors are the major causes for people considering that all Muslims vote for the Congress whatever be the case.
    Let me also assure you that the perception is changing and let me correct myself; Not a perception but the actual truth.
    During the run up for the election for Gujarat where Shri. Modi was elected as the Cheif Minister last year, there was an interview by a very “Secular” weekly of a village were all the residents were Muslims; When asked whom they were going to vote for they said MODI!!

    Tarique can happily concoct his own fantasy tale and try to deflect the blame from the true culprit – Islam. But he’s not fooling anyone around here.

    Here’s what I compiled from news sources on the Jihadi-led massacre at Varanasi (the Hindu equivalent of Mecca):

    The powerful bomb was set off at dusk in the courtyard of the 400-year old Sankat Mochan temple, dedicated to Lord Hanuman, as thousands of Hindu worshippers gathered for the evening oil-lamp prayers on March 7, 2006. The bomb was placed in a container near a gate at the temple where women devotees usually sit.

    Tuesday is the most auspicious day at the sacred Sankat Mochan temple in the 3000-year old city of Varanasi, and dozens of Hindu couples had come to Sankat Mochan to be blessed in marriage. The temple was packed with Hindus going to pray.

    The date and time of the explosions was selected for causing maximum damage. The CBSE and ISC Examinations (India’s school leaving examinations) were in progress and therefore there were many students and worshippers at the temple when the bombs exploded during the Aarti ceremony.

    The BBC’s Mark Dummett in Varanasi says a wedding party took the brunt of the blast at the Sankat Mochan temple. He says shoes of devotees lie scattered on the ground, which is stained with blood. Flies are everywhere.

    Atif mentioned how he placed a bomb at the Sankatmochan Temple in Varanasi. Atif told Nisar in graphic detail how he placed the bomb near a tree in the temple premises where four couples were getting married.

    But then Atif showed him a larger reason for all this bloodshed. He said – “It’s not for me or you; it’s for Allah.”

    At Varanasi, at least 28 Hindus were slaughtered and as many as 101 others were injured in the name of Allah. Six other bombs were defused.

    Most of the victims have been cremated on the banks of the Ganges in Varanasi.

    “I cradled him in my arms when he was a little baby and now these same hands will light the pyre of my only child,” a father at a cremation ground was quoted as saying by the AFP news agency.

    shantanu ,i will be very glad if u can devote blog to the works of mustapha bulent ecevit,his deep knowledge of sanskrit language,his interest in tagore and fluent accent of bengali language. he learnt sanskrit and bengali because he wanted to do a deep study of the ‘gita’ ,which in his latter years he ended up translating in turkish language for his countrymen.he was a deeply learned man and even his military invasions as prime minister were never viewed as ‘islamic jihad’ by anyone in the world . when he ordered his troops in cyprus he was asked the reason ,”the gita is my guiding force in this mission. i know if i m on the true path i will never falter”. he was an amazing personality respected worldwide for his vast reservoir of knowledge and his love for the ‘holy gita’. i wish shantanu’s blog could pay a glowing tribute to this great man.

    The Maharashtra ATS will (and must be) compelled into providing some evidence in the public domain- after having dragged the noble name of the Indian Army into the episode it would be pretty rich if it is allowed to get away without owning up any responsibility for acting in a precipitate manner.

    Is there any penal code that can be used for “bringing the honour of the Armed Forces and the nation to disrepute”?

    Despite whatever the MSM may have to say- the record of the Indian forces world over is a shining example of fortitude and honour. Based on what one has read- even in the MSM- this issue goes beyond the apparent ineptitude in putting a cogent case together.

    Has anyone ever come across- in any country- such mudslinging on a serving Intelligence Officer?

    To me, this looks like a clear message to the Intelligence Community in India- “do not dig too deep for you know not where you might find yourself”- not a very encouraging sign in times when the forces are being used for mitigating domestic terrorist activity…..for those of you keen to know how other countries facing the challenge of terrorism are reorienting their intelligence apparatus please see the MI-6 (or SIS as its properly known in the UK) website….this episode serves a lesson which I hope will be learnt and not easily forgotten- of how not to expose the national intelligence apparatus and how not to damage the reputation of the armed forces for addressing issues that are largely associated with internal political motivations….

    Actually, yes – ironically, or may be not, the federal government has been the guilty party on all occasions – there have been at least three episodes when serving officers have been vilified as spies, interrogated harshly, probably tortured, thrown into jail and then the govt has not been able to prove its charges and the courts have set the “accused” free.

    However, I never heard a peep from anyone about “honour of the Indian Army, human rights or freedom” in those cases.

    – Dara Shikoh was captured by Aurangzeb Alamgir, brought to Delhi, placed on a filthy elephant and paraded through the streets of the capital in chains. He was put on trial and received the Sharia death sentence as he was declared as an apostate from Islam – as prescribed by the Qu’ran.

    – On the night of August 30 1659, Dara was executed for apostasy and violating Quranic commandments on Shirk (the sin of idolatry or associating false gods with Allah).

    – That’s why Aurangzeb Alamgir is hailed as a pious Muslim and as a living Muslim saint (Pir) by the Ulema. His strict adherence to Islam and Sharia during his reign is still hailed today by the Ummah.

    – That is why the description of Aurangzeb Alamgir’s glorious deeds* sends Islamic clerics and their Indian congregations into raptures, during the Jumma Kutbah (Friday sermons).

    * His glorious deeds were the destruction of hundreds of magnificent Hindu Kufr temples, massacres of hundreds of thousands of Hindus/ Sikhs and forced conversions of millions of Hindus/Sikhs (the forefathers of today’s Muslims in the Indian subcontinent)

    Famous examples of his Quran-inspired Jihad include the Keshava Dev (Krishna Janmabhoomi) temple at Mathura (upon which a Idgah mosque was built) and the Tuljapur Bhavani temple in Maharashtra etc.

    The destruction of these temples were preceded by slaughtering a cow in each Garba Gruha (Sanctum Sanctorum) to the chants of Allahu-Akbar; a meticulous defilement of the Murti (sacred image) by pouring cow’s blood on the Murti, hacking off the statues into pieces and most definitely, by beheading all the devotees and pujaris praying in the temple.

    After all, PBUH gave the same treatment to the pre-Islamic Arab temples and the adherents of the peaceful, pre-Islamic Arab religion.

    Actually, the late Bulent Ecevit was the Prime Minister of Turkey, not the President as you mentioned.

    So, you are finally admitting that Bulent Ecevit was a just ruler because he was a follower of Gita, not the Qu’ran.

    Looks like his successor, the current Islamist President Abdullah Gul and Islamist Prime Minister Rashib Tayyab Erdogan (Recep Tayyip Erdogan) are hell-bent upon reversing Bulent Ecevit’s policies and is pushing for a greater Islamization of Turkey.

    No wonder, millions of apostate Turks protested the creeping Islamization of Turkey in various cities in 2007.

    1.5 million apostate Turks protested against Islamic rule in the port city of Izmir. I wonder why ?

    1.2 million apostate Turks protested in Istanbul with slogans of “No to Islam. Yes to Free Speech”.

    0.4 million apostate Turks protested similarly in the capital Ankara. Any guesses why?

    Looks like they don’t want to be part of the Ummah, as they have had enough of Islam for the past 500 years. As the saying goes: “A burnt child fears the fire.”

    I have lived in some countries of the Middle-East for some time and have traveled through several cities/villages in Turkey. The non-Islamic Turks fear Islam itself. They don’t want history repeating itself. They have realized that the pre-Islamic heritage of Turkey is their true heritage. They detest Islam.

    The present-day Turks owe a lot to “The Father of Modern Turkey” Mr. Kemal Ataturk who reversed history and brought Turkey away from the 7th century and closer to Europe.

    My Turkish colleagues adored Ataturk and told me so much about him. In a nutshell, Ataturk abolished the Islamic Caliphate (office of the successors to Muhammad, the supreme politico-religious office of Islam). He banned the Arabic script (and replaced it with the Latin script). He also banned the wearing of the Fez (Islamic caps) everywehere and banned the wearing of the Hijab in the Parliament and Universities. Ataturk shut down all Madrassas and Islamic institutions. He banned Islamic Sufi Missionary groups. He converted many prominent Mosques into Museums.

    My Turkish driver told me an interesting story, which may be symbolic. He said that Ataturk requested all the current Muftis and Imams in Turkey to assemble before him and told them to go perform the Haj in Saudi Arabia (on an all-expenses paid trip). When the ship carrying all the Muftis and Imams sailed away from the port, then Ataturk ordered his cannons to fire on the ship and sank the ship (along with the occupants).

    The Turks venerated him so much for such radical reforms that he was given the name ‘Atatürk’, meaning “Father of the Turks”.

    Although today Turkey seldom figures in Muslim or Islamic discourse, it was for five centuries the center of the Muslim world, until that fatal day, March 3rd, 1924, when Mustafa Kemal Pasha Ataturk abolished the Caliphate -office of the successors to prophet Muhammad, the supreme politico-religious office of Islam, and symbol of the Turkey sultan’s claim to world leadership of all Muslims—was abolished.

    Today 98% of Turkey’s population is officially Muslim but the proportion of practicing Muslims is as low as 20%. However unlike in Europe where church attendance gradually fell in Turkey it is the result of a systematic attempt to constrain and weaken Islam by successive Kemalist secular governments and the military.

    The hostility towards Islam began in early 1920s. A military commander, Mustafa Kemal Pasha led the Turkish War of Independence to form the Republic of Turkey as the successor state of the defunct Ottoman Empire. For this Mustafa Kemal became very popular and adored by all Turks. Thereafter he became the first President of the Republic of Turkey. The Turks venerated him so much he was given the name ‘Atatürk’, meaning Father of the Turks, (honorific name formally presented to him by the Turkish Grand Assembly in 1934.)

    But Mustafa Kemal Pasha Ataturk was no ordinary leader. He was an astute statesman and strewed strategist. He didn’t express to the public how he would develop Turkey until he got the power to execute his vision (i.e. not until he was President of Turkey.)

    Then Atatürk carefully constructed and deployed a master plan, today known as the Kemalist ideology or Kemalism. Believing in this strategy Ataturk and his associates started to publicly question the value of religion and held the view religion was not compatible with modern science and secularism was imperative for modernity.

    Thus Ataturk regime began step by step to implement the Kemalist ideology with a radical reformation of the Turkish society with the aim of modernizing Turkey from the remnants of its Ottoman past. In line with their ideological convictions the Ataturk government abolished Islamic religious institutions; replace the Shariah law with adapted European legal codes; replaced the Islamic calendar with the Gregorian calendar; replace the Arabic script which was used to write the Turkish language with the Latin script and closed all religious schools.

    In addition Ataturk took over the country’s 70,000 mosques and restricted the building of new mosques. Muftis and imams (prayer leaders) were appointed and regulated by the government, and religious instructions were taken over by the Ministry of National Education. Mosques were to preach according to the Ataturk’s dictates and were used to spread the Kemalist ideology.

    Atatürk confiscated Sufi Muslim lodges, prayer halls, meeting places and outlawed their rituals and meetings.

    According to Ataturk, modernity was valued and represented as not wearing any religious Islamic dress or being non-Islamic. So he ordered what cloths Turkey’s citizens should wear. The traditional Islamic garb of local religious leaders was outlawed. The fez (Turkish Muslim cap) was banned for men and the veil and hijab (headscarves) were discouraged and restricted for women.

    Atatürk and his colleagues wanted to Turkify Islam. They ordered Muslims to use the Turkish word “Tanri” instead of Allah for God and use the Turkish language in Salaath (the 5 times prayers) and Azaan (the call for prayers).

    After some time the Atatürk regime moved towards more extreme measures. Ataturk prohibited religious Islamic education. The existing mosques were turned into museums or used for the regime’s secular purposes.

    The Turkish and Kurdish Muslims be they Sunni, Shia or Sufi were powerless against Mustafa Kemal Ataturk’s regime and his military. So they led violent rebellions against the Turkish state. But he was too strong for them and Ataturk suppressed the rebellions. (e.g. Seyh Sait rebellion in southeastern Turkey which claimed nearly 30,000 lives before being suppressed had its roots in religious grievances.)

    Mustafa Kemal Ataturk died in 1938. After that some of his laws were revoked by his successors. Since then there have been regular calls for a return to Islamic rule. But the anti-Islamic governments and military true to the Kemalist ideology have managed to halt their plans.

    While the current President Abdullah Gul and PM Recep Teyyep Erdogan (Rashib Tayyab Ergogan) are hell-bent upon Islamizing Turkey and gradually imposing Islamic Shariah laws step-by-step, they are luckily facing fierce resistance from the Turkish Military which has been de-Islamicised by Ataturk.

    If only the rest of the Islamic world would follow Ataturk’s example. The world would be a better place to live in.

No. 8/CO502314/MK/NK/NCW/2008/5371] and Director General of Police A.N. Roy [D.O. No. 8/CO502314/MK/NK/NCW/2008/5370] seeking factual information regarding the alleged illegal detention and torture of Sadhvi Pragya.

    …Dr. Vyas wrote a personal letter to the new Chief Minister Ashok Chavan on 8 December 2008, pointing out that neither the Chief Secretary nor the Director General of Police had replied to the Commission’s queries, a situation that was unchanged till 16 December 2008, when some petitioners met her for a follow-up. As the petitioners had taken up the issue of gross abuse of Sadhvi Pragya’s human rights, dignity, civil liberties, and reputation by the Maharashtra Anti-Terrorism Squad, after her sworn affidavit was submitted in the Nashik court on 17 November, it would be relevant to revisit the charges made therein.

    …On 12 October, the officers lost patience and became aggressive. Initially, Bhimbhai Pasricha was asked to beat her on her palms, forehead, soles of feet, etc with sticks and belts, and beaten severely upon his refusal. When he succumbed to the pressure and beat her, he could not bring himself to seriously inflict pain upon her, so he was thrust aside and the Sadhvi beaten by policeman Khanwilkar, receiving bruises, swelling and contusions.

    This torture continued for several days; often she would be woken up at night or early morning, repeatedly questioned, abused, beaten; even her Guru was abused and her chastity questioned. Thus traumatised physically and mentally, she told the court that she even wanted to commit suicide.

    …So stressful was the custodial violence and the resultant mental stress, that Sadhvi Pragya developed acute abdominal and kidney pains, and became nauseous, giddy, and prone to bouts of unconsciousness. This necessitated removal from the hotel and transfer to the Shusrusha Hospital, where she was kept in the ICU. This is a very major development in the case, and it is truly surprising that the media has not tried to interrogate the hospital management in this matter.

    …Throughout this period of illicit custody, torture, transfer to a hotel, and then to two consecutive hospitals, NO female police constable was ever by her side. It is pertinent that after Sadhvi Pragya submitted her sworn affidavit in court on 17 November 2008, the ATS never officially or unofficially denied her charge that female police officers were never present during the custody of the Sadhvi.

    …Till 24 October, she had been denied access to a lawyer or any member of her family. During the course of her illegal detention, two polygraph tests and a narco analysis was conducted on her without her consent.

    The NCW, a reminder notwithstanding, has yet to respond with a complaint number to my formal complaint dt Nov 19 to it for an inquiry into the alleged torture of Sadhvi Pragya. [Nor, for that matter, has the NHRC!]

    The recent MPs’ report on the cash-for-votes scam notes that “the overwhelming evidence is that Narco-analysis is by no means a reliable science” (http://www.dailypioneer.com/143993/The-anti-climax.html).

    None of our well-known “secular” and “human rights” activists has spoken out for an inquiry!

There might have been a Namboodiri called Narayanan whom people also called a Guru (Narayanan is a very common name). Normally, when a Malayali talks of Narayana Guru, he means the man who was born into a low-caste Ezhava family. The same man, when faced with protests for consecrating a Shiva temple (a task performed only by dvijas) said that the deity was an Ezhava Shiva. Just because Tarique happens to be a North Indian Muslim who doesn’t know anything about Kerala, you shouldn’t feed him stuff like this. I hope this was a genuine mistake.

    And I feel that you are mixing up your Kerala history. Sir CP Ramaswami Aiyar, the Dewan of Travancore may have supported the temple entry issue – we are talking here of only of the Vaikom temple. The proclamation was signed by the Travancore Maharaja AFTER a long-drawn Satyagraha which did encounter a very violent opposition. And, incidentally, the issue was not temple entry – it was for permission for low castes and untouchables to walk on the approach roads to the temple. And this was not a gracious gift. It was a right fought for and wrested from the hands of the Maharaja. Guruvayur, however, was in Malabar and the Samuthirippadu (Zamorin, as they called him) was the man in charge. Two different temple administrations. The Satyagraha started in 1931, and even after a referendum which showed a majority of the high caste Hindus in favour of allowing the polluting castes to enter the temple, Harijans were allowed into the temple only in 1946. The point is, no Sir CP, and no gracious bowing to the demands of the people. This is not to negate the contributions of the people from the upper castes in the reform movements in Kerala. But you need to get your facts a bit straighter.

    The Armed Forces Tribunal (AFT) on Wednesday asked the Army to reconvene the probe against Malegaon blast accused Lieutenant Colonel Shrikant Prasad Purohit, holding that the Court of Inquiry (CoI) against him “suffers from the vice of irregularity”.
    Pronouncing the verdict on a petition by Purohit, arrested in November 2007, Justice S.S. Kulshreshtha observed that certain witnesses were examined by the Army in absence of Purohit who had “no opportunity to cross examine them”, which violated the Army rule 180.

    Read the starting sentence of this post…and then read Chaitanya’s recent piece, Sadhvi Pragya Thakur and human rights from which some extracts (emphasis added):
    We still cannot confirm whether she was subjected to torture or whether all her newly acquired disabilities are because of custodial torture. We simply do not know enough and cannot make conclusive claims based on half knowledge and hearsay.
    ..What all this shows is that there is a lot of confusion and specualtion about the veracity of the allegations that the Sadhvi was tortured. Whether Sadhvi was tortured or not is also very much a matter of faith, based roughly on which side of the political spectrum you are on.

    What is striking though is the astounding silence with which these reports have been treated from those human rights activists and NGOs who claim to be fighting for human rights. Let us see the allegations: custodial torture in the form of physical, verbal and mental abuse, arbitrary detention, multiple narcoanalysis tests without consent. All are standard human rights violations that provoke a great deal of report writing and moral indignation from human rights organizations. However, those who are out in force when there are allegations of fake encounters or custodial torture of terror suspects or belonging to a certain religious group [1, 2, 3, 4, 5] by writing feverish conspiracy-themed reports, shaming our democracy and jolting our collective conscious into action, are not seen in action here. Sadhvi is indeed charged with a very serious crime but the lack of human rights activism for her human rights is in great contrast to that displayed for the ‘Butcher of Mumbai’ Pakistani national Amir Ajmal Kasab after he was convicted and sentenced to death for an equally serious crime.

    This can be easily construed as taking sides.
    …If anyone is taking sides, it is the human rights activists and NGOs who are sympathetic to torture and fake encounter victims coming from a certain section of society but are nowhere to be seen in the case of Sadhvi Pragya Thakur. They have already taken sides. This is a clear contradiction and double standard that exposes the vacuousness of the claims of human rights activists and NGOs that they are fighting for human rights and proves that human rights is secondary to their primary agendas, whatever they may be. If they are really fighting for human rights, they would not apply different standards to different people and take sides. Sadhvi Pragya Thakur should have been a human rights cause by now. But she isnt. We suspect it could have something to do with her religious and ideological persuasions.

    10. What we have against the Muslims arrested by the State Police and against the Hindus under investigation by the Central agencies is a series of allegations, insinuations and conjectures, but no legal evidence which will stand scrutiny in a court of law.

We have had the intriguing spectacle of the NIA not opposing bail applications from the nine Muslims originally arrested by the Maharashtra ATS, but at the same time refraining from ordering a closure of the investigation against them by submitting a Final Report in the case. The FR would have ended the investigation once and for all unless some fresh evidence was found, warranting a re-opening of the investigation. The Muslims released on bail would have been deemed innocent—neither accused nor suspects. By not opposing bail to them and at the same time, by not submitting a Final Report in the case, the NIA has kept them under the status of no longer accused, but still suspects. This doesn’t re-establish their honour in the eyes of the society.

    12. In the case of the Hindus arrested in connection with some cases of reprisal terrorism, the facts and circumstances are exactly the same as in the case of the nine Muslims arrested in connection with the Malegaon 2006 blasts—-that is, apart from the retracted confession of Swami Assemanand, there is hardly any circumstantial and forensic evidence against them. And yet they have been treated as suspects as well as accused. The mitigatory yardstick followed in the case of the Muslims has not been followed in the case of the Hindu suspects, one of whom is a religious lady. In the eyes of the Government of India, it is all right to be harsh with the Hindus, but not with the Muslims. Deplorable double standards adopted in the case of the two communities.

    13. The result of the blatantly differential handling of Muslims and Hindus in the application of the same laws of criminal procedure would be to add to their anger against each other and against the Government. We will be playing into the hands of the jihadi terrorists and their Pakistani sponsors by aggravating the polarisation between the two communities and facilitating the Pakistani objective of creating a wedge between them….

    In the brief span of a year, the Supreme Court has established different norms for granting bail to minorities and other privileged members of society vis-à-vis Hindus arrested under draconian laws. The new Chief Justice Altamas Kabir reinforced this trend on October 19 when he headed a Bench that granted bail to journalist Syed Mohammad Ahmed Kazmi, arrested on March 6 in the Israeli diplomat car attack case. Syed Kazmi thus follows Kanimozhi and other accused in the 2G scam for whom the Apex Court upheld bail as a constitutional right, as opposed to denial of bail to Sadhvi Pragya and others, accused in the 2008 Malegaon blast case where the prosecution is hard-pressed to make a viable case.

    Is the Malegaon 2006 blast case doomed? It started off with the Maharashtra ATS arresting several Muslim youth claiming that they were behind this attack and over the years the theory changed and a new set of accused comprising Hindus came into the fray.

    There was so much hoopla around the arrest of Sadhvi Pragya Singh Thakur who was named as one of the main accused in the case. However what is surprising is that her name does not even figure in the chargesheet which has been filed by the National Investigation Agency which took over the case from the Maharashtra ATS. Sources tell rediff.com that there was not enough evidence on hand to file a chargesheet against Sadhvi Pragya Singh and even if they were to file a supplementary chargesheet her name may not figure in it…

    …The Anti Terrorism Squad of Maharashtra police today opposed the discharge applications of nine Muslim accused arrested in the 2006 Malegaon blasts case.

    The court had directed ATS to submit its say on the discharge applications, after one of the accused belonging to a right-wing Hindu group demanded that court seek replies of CBI and ATS on the issue.

    The National Investigation Agency, which took over the probe from other agencies at a later stage, has exonerated these Muslim accused, and claimed that the blasts were in fact the handiwork of members of a Hindu extremist group.

    On Friday, NIA informed a special court in Bhopal that it has got the MHA’s nod to file a charge-sheet in the Sunil Joshi murder case and requested the court to grant time to prepare the charge-sheet, which was granted. Court has fixed the next date of hearing on August 19.

    “Preparing a charge-sheet needs time. After scrutiny, MHA cleared our investigation report which was submitted in January this year. We will submit the charge-sheet against all accused, including Pragya Thakur,” counsel for NIA, Subhash Bhattacharya, told TOI.
